Neither consumers nor companies have used their possibilities in an optimal way yet. For further information see the web site of the European Commission. Case of the MonthThis time the case of the month is about product liability. An Italian consumer bought an expensive racing bicycle with a lock crown produced by a French company.During a bike tour in the mountains that carbon crown was broken and fell down. Thus, the frame of the bike was damaged. The consumer contacted us to ask whom he should refer to for the repair of his expensive bike. To the trader? For cases like this one, where a product is damaged by another product, the art. 114 of the consumer codex says that 'the producer is liable for damages caused by his faulty product...' Therefore we contacted the French producer with the help of our colleagues from the European Consumer Centre in France and asked him to repair the broken frame of the bike. A technical report, which was asked by the producer company, finally proved that the damage was really caused by the rupture of the crown. In the end, the French producer firm paid for the repair of the frame.
